You are solely responsible for safeguarding your account password and for any activities that occur under your account. You must be at least 13 years old to use the Service. If you are under 18, you must have the permission of a parent or legal guardian, who also agrees to be bound by these Terms.
4. User Conduct and Obligations
You agree not to misuse the Service. This includes, but is not limited to:
- Providing false or misleading information in your profile or assessments.
- Using the Service for any illegal or unauthorised purpose.
- Attempting to interfere with the proper functioning of the Service, including by introducing viruses or other harmful code.
- Infringing on the intellectual property rights of PathwayPal or any third party.
5. Intellectual Property Rights
All rights, title, and interest in and to the Service, including its "look and feel," content, assessment algorithms, and all underlying technology and software, are and will remain the exclusive property of PathwayPal and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. You may not copy, modify, distribute, sell, or lease any part of our Service or included software.
6. Your Rights and Your Content
You retain all rights to the personal data you submit to the Service, such as your assessment answers and profile information. By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to use, process, and display this data solely for the purpose of operating, providing, and improving the Service as described in our Privacy Policy.
If you provide a testimonial or other feedback, you grant us a perpetual, irrevocable right to use and display it for marketing and promotional purposes.
7. Fees and Payment
Certain features of the Service may be provided for a fee. If you choose to subscribe to such features, you agree to the pricing and payment terms as we may update them from time to time. All fees are non-refundable, except as required by law or as otherwise stated in our payment terms. Your statutory rights, including any "cooling-off" period under the Consumer Contracts Regulations 2013, will be clearly outlined at the point of purchase.
8. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide a high-quality service, we make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. The information provided does not constitute professional advice and you should not rely on it as such.
To the maximum extent permitted by applicable UK law, PathwayPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service. Our total liability to you for any claim arising out of these Terms or the Service will not exceed the amount you paid us, if any, in the 12 months preceding the claim.
Nothing in these Terms is intended to exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by English law.
9. Your Consumer Rights
These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation.

12. Changes to these Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you, for example, by posting the modified Terms on the site or by sending you an email, at least 30 days before the changes take effect.
